3.- PATENT REQUIREMENTS

For an invention to become the object of a Patent, three basic requirements must be met: novelty. Invention activity and industrial application.

An invention is considered new when it is not included in the state of the technique. The state of the technique consists of everything which has been made available to the public through a written or oral description, through a use or any other means.

An invention is considered to involve an invention activity if it is not the consequence of the state of the technique in an evident way to an expert.

An invention is considered to be liable to industrial application when its object can be manufactured or used in any kind of industry, including agricultural.
